Terms of Service

Please read carefully. These Terms of Service (“Terms”) govern your access to and use of Prismy, including AI-powered photo and video features. By downloading, accessing, or using Prismy, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Agreement

These Terms form a binding contract between you and Prismy. Additional in-app disclosures, consent prompts, and store product pages may apply to specific AI features and are incorporated by reference where presented to you. Contact: support@moonlenses.com.

If a registered corporate entity operates the Prismy developer accounts, that entity’s legal name should appear here for store and contractual consistency.

2. The Service

Prismy provides tools to create and edit photos and short videos, which may include (without limitation): portrait retouch, enhance, erase, expand, restore, style looks, prompt-based generation, image fusion using your photos, and photo-to-motion / video features. Features may change, be added, limited by region, or discontinued.

Some features require an internet connection, an account, credits, a subscription or one-time purchase, or device permissions (camera, photos). We may use on-device and/or cloud processing, including third-party AI models from ByteDance, Google, and OpenAI, to deliver features.

3. Accounts & eligibility

You must be at least 13 years old (or the higher minimum age in your country, including 16 where required) to use Prismy.
Prismy requires or offers account login. You must provide accurate information and keep credentials secure. You are responsible for activity under your account.
You may request account deletion as described in the Privacy Policy or by contacting support@moonlenses.com.

4. AI features — special terms

Third-party AI & compliance. Prismy integrates third-party AI products, services, models, SDKs, and APIs, including providers such as ByteDance, Google, and OpenAI. Those components must be used in a manner consistent with Google Play User Data policy (limited use, clear disclosure, and required consent) and Apple platform rules. We remain responsible for the overall compliance of personal and sensitive data handling in the app, even when processing is performed by a third-party AI provider.

4.1 How AI features work

When you use an AI feature, you instruct Prismy to process inputs you provide (such as photos, videos, prompts, and settings). This may include image fusion and other face-containing image processing needed to align, blend, retouch, or animate your photo. Processing may occur on your device and/or on servers operated by us or our providers. Results may vary and are probabilistic.

4.2 Consent & disclosure

Certain AI features require prominent in-app disclosure and your affirmative consent before personal or sensitive user data (including photos that may contain faces) is processed or transmitted to cloud AI providers. If you decline, the feature will not proceed.

4.3 No training on your content; no long-term output library

We do not use your User Content or generated outputs to train our own models. We do not store generated outputs in a long-term content database; results are delivered for you to save on your device. Temporary processing copies may exist only as needed to complete a job and for security/abuse prevention, as described in the Privacy Policy.

4.4 No professional advice; no guarantees

AI outputs are for creative and entertainment purposes. They may be inaccurate, biased, distorted, or unexpected. Prismy does not guarantee that outputs will be unique, available, fit a particular purpose, free of third-party rights issues, or accepted by social platforms.

4.5 Safety filters & monitoring

We may use automated and manual systems to detect abuse, illegal content, and policy violations (including scanning inputs/outputs where permitted). We may block, refuse, or remove content and restrict features accordingly.

5. Your content

“User Content” means photos, videos, prompts, audio, text, and other materials you upload, submit, or generate through Prismy.

You retain ownership of your User Content, subject to the licenses below and rights of third parties (e.g., people depicted, trademarks, copyrighted works).
You represent that you have all rights and consents needed to submit User Content—including consent from individuals whose likeness appears in images used for fusion or portrait features, where required by law.
You grant Prismy a worldwide, non-exclusive, royalty-free license to host, store temporarily, reproduce, process, modify (for formatting/processing), transmit, and display User Content solely to operate, secure, and provide the Service features you request, including transmission to ByteDance, Google, and OpenAI for inference, and as otherwise described in the Privacy Policy.
We do not claim ownership of your User Content. We do not use your User Content to train our own models.

6. Generated outputs

Subject to these Terms, applicable law, and third-party rights, as between you and Prismy you may use outputs you generate for personal or commercial purposes. However:

Outputs may be similar to outputs generated for other users; Prismy does not guarantee exclusivity.
You are solely responsible for how you use, publish, or commercialize outputs, including compliance with publicity, privacy, copyright, trademark, and platform rules.
You must not present AI-generated or AI-edited media as unaltered authentic imagery of real events or real people when doing so would be deceptive or unlawful.
Because we do not keep a permanent cloud library of outputs, you are responsible for saving results you want to keep on your device or elsewhere.

7. Acceptable use

You agree not to use Prismy to:

Create, upload, or disseminate child sexual abuse material or any sexual content involving minors (including fictional depictions). We have zero tolerance and will report as required by law.
Create non-consensual intimate imagery, sexual deepfakes, or exploitative content of real people
Impersonate a real person in a deceptive way, commit fraud, or interfere with elections or civic processes through deceptive media
Fuse or edit another person’s likeness without required rights or consents
Violate others’ privacy, intellectual property, or publicity rights
Generate content that promotes terrorism, violent extremism, or severe harm
Attempt to reverse engineer, scrape, overload, or disrupt the Service, or bypass safety filters, rate limits, or payment systems
Use the Service in violation of Google Play, Apple App Store, or applicable law

We may investigate violations, remove content, suspend accounts, and cooperate with platforms and law enforcement.

8. Credits, subscriptions & purchases

Prismy offers subscriptions and one-time / consumable in-app purchases (including credit packs), as shown in the app. Prices and benefits are displayed in the app and billed through Apple App Store or Google Play.
Credits are a limited license to request eligible generations/edits. Credits have no cash value, are non-transferable, and do not expire under our current product rules (unless a specific offer states otherwise at the time of purchase, or applicable law requires a different treatment).
Subscriptions renew automatically unless canceled through your Apple or Google account settings before the renewal date. Manage or cancel in the applicable store—not by deleting the app alone.
Refunds are handled according to Apple or Google policies, except where mandatory local consumer law provides otherwise.
We may change pricing or credit costs prospectively. Failed jobs due to our confirmed service outage may be eligible for credit restoration at our reasonable discretion.

9. Our intellectual property

The Prismy app, brand, UI, logos, documentation, and software are owned by us or our licensors and protected by intellectual property laws. Except for the limited right to use the Service as offered, no rights are granted to you.

10. Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal data, including account login, advertising identifiers, analytics (Adjust, AppsFlyer, Firebase), face-containing image processing / image fusion, and AI providers (ByteDance, Google, OpenAI). By using Prismy, you acknowledge that policy.

11. Third parties & app stores

The Service relies on third-party services, including AI providers and analytics partners. We are not responsible for third-party sites or services we do not control, except that we remain responsible for how personal data is handled through Prismy as described in the Privacy Policy. If you download Prismy from Apple or Google:

These Terms are between you and Prismy, not Apple or Google, except that Apple/Google may enforce their standard EULA / distribution terms.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms with respect to the iOS app, where applicable.
Maintenance and support are our responsibility (support@moonlenses.com), not Apple’s or Google’s, subject to store rules and law.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT AI OUTPUTS WILL MEET YOUR EXPECTATIONS OR BE FREE FROM HARMFUL COMPONENTS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRISMY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE OR AI OUTPUTS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING FOR DEATH/PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FRAUD).

14. Indemnification

You will defend and indemnify Prismy and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your outputs, your misuse of AI features (including fusion of others’ likenesses), or your violation of these Terms or law.

15. Suspension & termination

You may stop using Prismy at any time and delete your account where available. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity) will survive termination. Unused credits may be forfeited upon termination for cause; otherwise treatment of balances follows store rules and applicable law.

16. Changes

We may update these Terms. Material changes will be indicated by updating the “Last updated” date and, where required, by in-app notice. Continued use after changes become effective constitutes acceptance, except where mandatory law requires explicit consent.

17. Governing law & disputes

These Terms are governed by the laws applicable to the operator of the Prismy Service, excluding conflict-of-law rules, except where mandatory consumer protections in your country of residence provide otherwise, or where Apple/Google dispute processes apply to store purchases. For a formal exclusive venue clause, insert the courts of your registered company’s home jurisdiction when that entity name is finalized.
