1. What we provide
Prismy offers AI-assisted image generation, video creation, photo editing, and related creative capabilities. Features available to you are presented in the product and documentation and may change over time.
2. Access and eligibility
You may use Prismy only in accordance with these Terms and applicable law. If accounts are offered, you must provide accurate information, safeguard credentials, and notify us of unauthorized use. If you use Prismy for an organization, you represent that you are authorized to bind it.
3. Subscriptions, auto-renewal, and billing
Prismy may offer auto-renewing subscriptions or paid credits to unlock advanced features. Available plans, pricing, billing cycles, currency, taxes, and included features are displayed at purchase.
Unless you cancel before the renewal deadline disclosed at purchase, a subscription may renew automatically for the next term. App-store purchases are charged to the account connected to that store and can be managed in that store’s account settings. Upgrades, downgrades, and refunds are handled as disclosed at checkout and by applicable app-store or consumer-protection rules.
4. Payment methods
For paid plans, you must provide a valid payment method and authorize Prismy and its processors to charge applicable fees. You are responsible for failed charges caused by expired or insufficient payment methods and should keep your details current.
5. License and acceptable use
Subject to these Terms, Prismy grants you a limited, non-exclusive, non-transferable, revocable license to use the Services. You may not reverse engineer or bypass protections; create unlawful, infringing, fraudulent, hateful, exploitative, or misleading content; run abusive automation; impersonate others; violate third-party intellectual-property or privacy rights; or use output for high-risk medical, legal, or safety decisions without qualified independent review.
6. Your content and intellectual property
You retain rights in prompts, images, video, documents, and other original materials you submit, subject to applicable law. You grant Prismy a worldwide license to host, process, transmit, and display that content as needed to operate the Services.
AI output may be inaccurate, non-unique, or subject to different legal treatment depending on jurisdiction. You are responsible for reviewing output, complying with law, and obtaining any required third-party permissions.
7. Third-party services and assets
The Services may integrate third-party APIs, fonts, music, imagery, or models governed by separate terms. Your use of any finished work must comply with applicable licenses and restrictions.
8. Disclaimers
To the fullest extent permitted by law, Prismy is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement. AI output may be incorrect; verify it before relying on it.
9. Limitation of liability
To the extent permitted by law, Prismy is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services. Our aggregate liability for a claim will not exceed the greater of fees you paid for the relevant Services in the twelve months before the claim or USD $100.
10. Termination
You may stop using the Services at any time and cancel a subscription as provided in the product. We may suspend or terminate access for serious violations. Terms that should survive by their nature, including disclaimers, limitations, and dispute provisions, will survive termination.
11. Compliance and export controls
You represent that you will not use the Services in violation of sanctions, export-control laws, or other laws applicable to you.
12. Changes to these Terms
We may update these Terms by posting a revised version. Where required, we will provide reasonable notice of material changes. Continued use after the effective date constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction selected by Prismy with counsel. Before bringing a formal claim, the parties should attempt good-faith negotiation. Any unresolved dispute may be brought in the court or arbitration forum specified by applicable law or a later written notice.
